On April 15th 2024, CPSC regulator Richard Trumka Jr. acted unilaterally, without data or due process, and sent letters to major retailers stopping sales of Nested Bean’s patented infant sleepwear, hurting families who have relied on our innovative infant sleep solutions for over a decade.
Nested Bean has reached out to many lawmakers to raise awareness of this egregious agency overreach, requesting support and action.
Dangers of Status Quo
Makeshift solutions created by sleep deprived parents, desperate for some rest, often expose several unsafe sleep practices, demanding innovation of effective and safe alternatives.
Nested Bean’s innovative infant sleepwear mimics the gentle touch of a parent with 1-2 ounces of filling, and provides uninterrupted comfort as babies sleep. The concept is inspired by research in parental touch simulation involving pre-term infants. Since 2011 Nested Bean has delivered over 2.5 million units to families with a strong safety track record.
AAP Recommendations Without Specificity
In June 2022, the American Academy of Pediatrics published the Revised Safe Sleep Guidelines in which the AAP recommended against the use of weighted infant swaddles and sleep sacks without specifying weight thresholds or sighting evidence. In a market filled with infant sleep products with product weights ranging from a few ounces to a couple of pounds, these broad guidelines lacking specificity severely hurt Nested Bean’s lightly filled products.
Nested Bean Contributions and Outreach
Since 2022 Nested Bean has participated in ASTM efforts to create regulatory standards for wearable infant sleep products, including filled products, and shared information with CPSC regulators and lawmakers on its design principles, underlying research and test results.
Commissioner Trumka’s actions have impacted 80% of company sales and our ability to deliver on our promise to parents with safe sleep alternatives that challenge the status quo.

CPSC's Refusal to Retract
When asked for a comment, the CPSC Commission told Fox News Digital that Commissioner Trumka acted “in his individual capacity as a member of the Commission, and not on behalf of the Commission itself”, yet as of October 2024 the Commissioner's baseless statements and harming actions have not been retracted or changed. Our products have still not been reinstated on retailer sites and stores.
